1.CANCELLATION AND NO SHOW 

– Reservations that are cancelled, reduced in length of stay or reduced in numbers [hereinafter collectively called a CANCELLATION] are subject to Cancellation and No Show Fees as follows:

PEAK SEASON HIGH/MID LOW SEASON

0 – 14 days 100% 0-7 days 100% 0-3 days 100%
15 – 25 days 50% 8-14 days 50%
26 – 45 days 25% 

2. TERMS AND CONDITIONS APPLICABLE TO PAYMENTS:

1) Payment: A 30% deposits payable upon confirmation.
2) The balance of 70% is payable 1 month prior to safari arrival.

3. GOVERNMENT TAXES:
Should the Government increase or decrease taxes or institute new taxes, Umani Bliss Safaris reserves the right to alter the prices as per the law.

4. FORCE MAJEURE:
The company is not responsible for unfulfilled accommodation, services or contractual obligations that result from force majeure or circumstances beyond control of the company. Such occurrences include cases of war, insurrection, acts of terrorism, political upheaval, labor disputes, strikes, laws or regulations, boycotts, epidemics, contagious diseases or other circumstances of whatever kind or nature that unfavorably affect the Company operation.

5. LIABILITY CLAUSE:
Umani Bliss will not accept liability for any incident of any nature involving the client which is not caused or contributed to by the gross negligence or willful default of Umani Bliss.

6. INSURANCE:
Guests are responsible for arranging their own travel and health insurance. Umani Bliss Safaris is not liable for any damage to you or your property and/or loss of your property/luggage during your safari or trip.

7. FLYING DOCTORS COVER:

We are currently offering an cover from Flying doctors. This is a cover for medical transportation from anywhere in Kenya to a hospital in Nairobi. This ‘insurances’ is for situations where you are in a medical emergency and need to be airlifted from a park or transported via ambulance from remote areas in Kenya.

DATA PROTECTION:
Both parties will comply with all applicable requirements of the relevant Kenyan Data Protection Legislation including the Data Protection Act, 2019 and (for so long as and to the extent that it has legal effect in Kenya), the General Data Protection Regulation (EU) 2016/679) and any other directly applicable regulations relating to privacy.

Without prejudice to the generality of this clause, both parties shall ensure that they have all the necessary appropriate consents and notices in place to the safaris run smoothly.

GOVERNING LAW:
The construction, validity and performance of this Agreement shall in all respects be governed and construed in accordance with the laws of the Republic of Kenya
